1. Who we are

By using this website, requesting a quotation or placing a booking, you accept these Terms and Conditions.

2. Who we contract with

Our services are provided to business customers (B2B). We do not provide services to consumers through this website. Each customer confirms that it acts in the course of its business activity when placing an order.

3. Services

We arrange and coordinate:

• Maritime freight transport
• Freight forwarding and logistics coordination
• Vessel chartering and leasing arrangements
• Container leasing and rental
• Cargo booking and port coordination
• Marine equipment and spare parts supply
• Vessel sale and purchase brokerage

4. Quotations and orders

All prices are quoted individually because freight, chartering and logistics pricing depends on route, cargo, equipment, timing and third-party tariffs. A quotation is valid for the period stated on it and is subject to space, equipment and carrier availability at the time of booking.

A contract is formed when we issue a written booking confirmation or a signed service agreement. Any customer terms printed on purchase orders do not apply unless we accept them in writing.

5. Customer obligations

• Provide accurate cargo descriptions, weights, dimensions and documentation
• Declare dangerous, restricted or temperature-sensitive cargo before booking
• Ensure cargo is correctly packed, marked and fit for the agreed transport
• Hold all required export, import and customs authorisations
• Complete our onboarding, KYC and sanctions screening requirements

6. Prices, invoicing and payment

Charges, currency, payment method and due date are stated on each quotation and invoice. Payment terms and tax treatment are set out in our Payment Policy, which forms part of these Terms and Conditions.

Where third-party costs (freight rates, bunker and currency surcharges, port dues, customs duties, storage or demurrage) change after the quotation is issued, those changes are passed through with supporting evidence.

7. Cancellation and refunds

Cancellation rights, cancellation charges and refund handling are set out in our Refund and Cancellation Policy, which forms part of these Terms and Conditions.

8. Liability

Where we act as a freight forwarder, our liability is governed by the mandatory rules of applicable Polish and international transport law and the relevant carrier conventions and bills of lading.

We are not liable for indirect or consequential loss, loss of profit or loss of market, and we are not liable for delay, loss or damage caused by events outside our reasonable control, including port congestion, weather, strikes, customs action or carrier failure.

Cargo insurance is not included unless expressly agreed in writing. We recommend that every customer arranges its own cargo insurance.

9. Compliance

All business relationships are subject to our AML, KYC and Sanctions Policy. We may decline, suspend or terminate any booking where compliance requirements are not met.

10. Governing law and disputes

These Terms and Conditions are governed by Polish law. The parties will first attempt to resolve any dispute amicably. Where that fails, the dispute is submitted to the court having jurisdiction over the registered office of LAMERZA SHIPPING SERVICES Sp. z o.o. in Wrocław, Poland.

Complaints are handled under our Complaints Policy.

11. Changes

We may update these Terms and Conditions. The version published on this page at the time of your booking applies to that booking.
